Consistent every magazine? If so, push the back of the slide forward to make sure it is fully in battery before pulling the trigger.
If that bypasses the problem, it may just be a lazy magazine spring or just a tight gun that needs more break in rounds.
I recently bought a new PF9. I put 4 rounds through it in the back yard to make sure it worked before starting to carry it. I know, I should have used it much more. I finally got to the range today and found it doesn't always strike the primer hard enough to fire it. It usually happens on the first or second round out of a full magizine. It happenned with two diffrent brands of ammo. I reused those rounds and they worked. I guess I'll have to check into returning the gun to the factory for service.
Well, sending it back to Kel-Tec (ask them to provide a prepaid shipping label) is always a good option. Seriously, if you can part with your pistol for a few weeks, just do it. They will probably ask to see your purchase receipt because recently they have started enforcing their warranty to the first purchaser policy.
On the other hand, it is surprising how often shooting a couple hundred rounds or performing the classic "fluff and buff" will eliminate problems that show up in the first few rounds. Yeah, I know it should be reliable out of the box (see the first line of the post).
We've been through several Kel-Tec's in our family and are down to two well broken in P-3AT's. For larger calibers, we shoot Kahr pistols or 1911's. But, back when we had both 9mm and .40 S&W Kel-Tec's (P11 & P40), it was a given that quite a few rounds and possibly some polishing were likely to be needed to get a good running Kel-Tec.
